The children's ombudsman is given the right to issue warnings and submissions to officials to prevent violations of the law. This is stated in the draft law "On the Representative of the Oliy Majlis of the Republic of Uzbekistan on Children's Rights (Children's Ombudsman)."
Under this draft law, the Children's Ombudsman is granted several rights:
- The children's ombudsman's report is expected to be heard annually at parliamentary sessions. Through this authority, the Children's Ombudsman brings urgent problems in the field of protecting children's rights to the parliamentary arena and proposes solutions.
- The children's ombudsman is given the right to issue warnings and submissions to officials to prevent law violations. Such a right enhances the effectiveness of the Children's Ombudsman's work. It allows appropriate measures to be taken against any official who violates the child's interests.
- The right of the children's ombudsman to participate in meetings of the Oliy Majlis, the Constitutional Court, the Supreme Court, and the Cabinet of Ministers and to introduce issues is being strengthened. Through this right, the Children's Ombudsman safeguards children's rights in parliament, executive bodies, and courts, focusing their attention on the priority of children's interests.
- Inquiry, investigative bodies, and the court are required to inform the Children's Ombudsman in writing about decisions and verdicts (sentences) involving minors in crimes against life, health, or sexual freedom. This awareness aims to prevent concealing facts of crimes against children, illegal termination of cases, non-investigation, or non-prosecution of such cases.
Simultaneously, the Children's Ombudsman is mandated by law to:
- Review the documents of criminal cases involving a minor and obtain copies of them.
- Protect violated rights, freedoms, and interests of the child, participating in legal proceedings for restoration purposes.
- Upon reviewing the verdict, the right to lodge a protest with the prosecutor's office is granted based on the child's interests.
Currently, the parliament is preparing for the second reading of this Law with the participation of deputies, experts from official agencies, and representatives of the scientific community.
For information, the legislative chamber of the Oliy Majlis recently passed the draft law "On the representative of the Oliy Majlis of the Republic of Uzbekistan on children's rights (Children's ombudsman)" in the first reading.
We'd like to remind you that Surayyo Rahmonova Mahmudovna was appointed as the Children's Rights Representative (Ombudsman) of the Oliy Majlis on October 28 of this year. Previously, Aliya Yunusova Tuygunovna held the position of child rights ombudsman and concluded her term last month.
