A brother and sister who sent nasheeds to each other are tried

21999In the Mingbuloq district of Namangan region, a brother and sister were sentenced for sending each other videos containing forbidden content and other religiously fanatical ideas. Aziz Obidov, press secretary of the Supreme Court, informed QALAMPIR.UZ about this.
According to the source, a 23-year-old resident of Mingbulok district, identified as M.A., along with his classmate M.M., had intentions of going to Syria for emigration and jihad after being influenced by forbidden religious lectures and the teachings of religious da'wah preachers on the internet through video platforms. However, when his classmate M.M. expressed concerns about the numerous conspiracies in Syria, M.A. decided against going.
In May 2021, M.A. went to work as a hairdresser in Kazan, Russia. During his stay in Kazan, he created personal profiles on Telegram and Instagram, through which he sent forbidden religious lectures and videos to his relatives, including his sister S.A. and brother B.A., as well as his classmate O.Q.
In the courtroom, the defendant M.A. admitted to sending the aforementioned audio and video lectures of religious content to his relatives, expressing remorse for his actions, and requesting leniency.
During M.A.'s sentencing, the court took into consideration his full confession, genuine remorse, and the absence of any previous convictions as mitigating factors.
He was found guilty of committing the crime specified in Article 244-1, Part 3, Paragraph "g" of the Criminal Code, which pertains to the preparation, storage, distribution, or display of materials that pose a threat to public safety and public order.
Furthermore, a criminal case was initiated against M.A.'s 19-year-old sister, S.A., and the verdict was announced on April 14. According to court documents, the defendant S.A. "distributed material containing fanatical ideas" through the internet.
Based on the expert opinion of the Committee on Religious Affairs, it was determined that these lectures propagated religious fanaticism.
During the court session, S.A. admitted to sending audio recordings of religious content to her brother M.A. She stated that when she asked him to delete the audio recordings, M.A. refused to do so until he returned to Uzbekistan. Later, realizing her mistake, she expressed regret and asked the court for leniency.
The defendant was found guilty of committing the offense described in Article 244-1, Part 3, Paragraph "g" of the Criminal Code, which relates to the preparation, storage, distribution, or display of materials that threaten public safety and public order. Consequently, the girl was sentenced to two years of imprisonment.
As per the court verdict, the girl is prohibited from leaving her place of residence between 22:00 in the evening and 06:00 in the morning. Additionally, the following restrictions apply during this period:
- Not participating in public and other events.
- Not changing the place of residence, work, or study without authorization from the relevant authorities.
- Not leaving the territory of Namangan region.
- Not using communication tools, including the internet.
Furthermore, it was determined that her phone would be cleansed of fanatical materials and confiscated for the benefit of the state, and her profiles on social networks would be deleted.
It should be noted that earlier in the Tashkent region, a young man who shared nasheed in a Telegram group was sentenced to three years of imprisonment. The sentence was imposed under Article 244-1 of the Criminal Code (preparation, storage, distribution, or display of materials that threaten public safety and public order) and Article 57 of the Criminal Code (provision for a lighter sentence).
