Draft decision on penalty points system published

17356On March 20, the draft government decision on evaluating traffic violations based on penalty points, titled "On the Introduction of a System for Evaluating Traffic Violations Using Penalty Points," was published. The draft has been posted on the public portal for discussion of regulatory legal documents.
According to the draft:
- Penalty points will be calculated from the date of a driver's first violation until the same date the following year.
- If a driver accumulates fewer than twelve penalty points within this period, the points will not carry over to the next calculation period, and the count will restart.
- Penalty points for traffic violations will be assigned solely based on administrative reports issued by the State Traffic Safety Service.
- The calculation of penalty points will be automated and conducted through the E-jarimaball module of the Unified Automated Information System of the Road Safety Service under the Ministry of Internal Affairs. Drivers will be able to check their penalty points at any time via the E-jarimaball module or a dedicated mobile application.
- If a driver contests a traffic violation and the case is reviewed in court, the penalty points will be assigned based on the final court decision.
- As an incentive, drivers who have not committed traffic violations for twelve months will have their first penalty point waived for the first violation in the subsequent period. However, this does not exempt them from other penalties.
- If a driver avoids committing specific traffic violations for six months after their last recorded offense, two penalty points will be deducted from their total. If they have fewer than two points, all points will be reset, and a new calculation period will begin from their next violation.
Drivers will be notified via SMS of each penalty point they accumulate for traffic violations. Additionally, an electronic database will be created to track individuals disqualified from driving due to excessive penalty points.
The new regulation will not apply to:
- Traffic violations not covered under Article 341¹ of the Code of Administrative Responsibility.
- Drivers of foreign-registered vehicles temporarily in Uzbekistan or in transit.
- Diplomatic missions, consular offices, and representatives of international organizations accredited by the Ministry of Foreign Affairs, along with their drivers (except for Uzbek citizens, permanent residents, and administrative, technical, and service employees of these organizations).
A table detailing the traffic violations and corresponding penalty points has been included in the draft.
Public discussion of the resolution will continue until April 4, and it is set to take effect on May 1.
