First-time administrative warnings introduced for certain traffic violations

In Uzbekistan, administrative warnings will now be issued for certain traffic violations. This comes as part of amendments to the Code of Administrative Responsibility, enacted yesterday, February 4, under Law No. 1116 of the Republic of Uzbekistan.

Under the new regulations, minor traffic offenses related to road safety may result in an administrative warning instead of an immediate penalty.

An administrative warning is an official notice given to an offender, alerting them not to commit actions that violate the law, while formally recording the infraction.

Such warnings may be issued in written or electronic form.

Administrative warnings apply to violations specified in the Code, including:

  •  Article 125, parts 1 and 2 (violations of vehicle usage rules);
  •  Article 128-1 (use of a phone while driving);
  •  Article 128-2 (watching TV or video programs on a monitor or display while driving);
  • Article 128-6 (violations of stopping and standing rules by drivers);
  •  Article 135-1 (failure of vehicle owners to comply with mandatory civil liability insurance requirements);
  •  Article 138, parts 1 and 2 (violations by pedestrians and other road users).

Warnings are applied when an individual shows genuine remorse for their actions and no other aggravating circumstances of violations specified in the Code are present. The authority responsible for enforcement decides whether to issue the warning.

An administrative warning may be issued to the same individual no more than once within a one-year period.

It should be noted that Uzbekistan previously introduced a strict list of administrative violations detectable through automated photo and video recording equipment.
