Employees of the Road Patrol Service may be allowed to use drug testers, in Uzbekistan

It is expected that employees of the Road Patrol Service will be allowed to use drug testers in Uzbekistan.  The draft of the Cabinet of Minister's decision "On amendments and additions to the regulation on the procedure for the interaction of road patrol officers with road users and the use of special devices" is intended for this change.  It was placed on the portal for discussion of projects of regulatory and legal documents.

It is noted in the draft decision that further improvement of the road safety system, prevention of controversial and conflicting situations that may arise in the interaction of road patrol officers with road users, and vehicle drivers' interaction of Road Patrol Service officers with road users, approved by Cabinet of Ministers Resolution No. 975 of 1 December 2018, to organize a rapid investigation using technical means to determine whether the person is under the influence of narcotic drugs and psychotropic substances by the appendix, amendments and additions are being made to the regulation on the procedure for the use of special devices and their relations:

• use of a special technical tool of a drug tester to determine whether drivers of vehicles are under the influence of narcotic drugs and psychotropic substances;

• determining the procedure for taking measures against drivers of vehicles in cases detected with the help of a drug tester.

According to the draft decision, the seventh paragraph of Article 2 of the regulation is supposed to be filled with the word "drug tester" after the words "mobile complexes, breathalyzer".

Clause 21 is also being deleted.  The word "under the influence" in the title of paragraph 2 is replaced by the words "under the influence of a drug or in a special way".
In paragraph 361, the word "under the influence" is replaced by the words "under the influence of a drug or in a different way", after the word "breathalyzer" the word "narcotester" is added.

Clause 362 is being filled with the word "narcotester" after the word "alkotester"

Clause 365 is stated in the following version:

"Investigation is carried out by a Road Patrol Service employee using a special device (breathalyzer, narcotic tester) by determining the amount of ethanol vapor concentration in the air released from the mouth cavity of the vehicle driver, or the presence of narcotics or psychotropic substances in the biological fluid (saliva) will be held".

Clause 367 is amended as follows:

"In cases where there is an objection to the results of the breathalyzer test of the vehicle driver, or the biological fluid (saliva) taken from the oral cavity of the vehicle driver is examined with the help of a narcotester, and his drug addiction" in cases where it is found that the person driving the vehicle is under the influence of alcoholic beverages, drugs or in a special state of intoxication, the Road Patrol Service employee will take him to the district (city) treatment and prevention institutions for a medical examination.
