The farmer has obtained 355 million soums from the Compulsory Enforcement Bureau (CEB)

According to the ruling of the Karshi inter-district economic court in the Kashkadarya region, 355 million soums are to be collected from the Compulsory Enforcement Bureau on behalf of the entrepreneur. This information was disclosed by Ismail Sayitov, an official from the Office of the Business Ombudsman, to QALAMPIR.UZ.

This case revolves around a dispute between the Nishan district branch of the Enforcement Bureau and a local farm. The CEB district office had initiated five enforcement cases to recover a total debt of 35 million soums from the farm between February 1 and October 23, 2022. However, without prior notification of the enforcement case initiation to the debtor, the tractor was seized from the farm's field and put up for auction.

Despite the farmer's repeated claims of incorrect debt calculation, clarifications, and timely payments upon warning, government officials disregarded them.

Moreover, the disproportionate seizure of property occurred, particularly a tractor bought with a loan of 977 million 500 thousand soums.

However, Article 60 of the Law "On the Execution of Court Documents and Documents of Other Bodies" stipulates that recovery should prioritize property directly involved in production, such as machinery and equipment.

Following this, the matter was brought before the Karshi inter-district administrative court, with the Business Ombudsman's office in Kashkadarya region advocating for the farmer's rights. Consequently, on December 7, 2022, the tractor was returned to the farmer.

Yet, the issue of damages incurred during the tractor's 49 days of illegal detention remained unresolved.

Subsequently, the farm pursued legal action against the Nishan district branch of the CEB to recover 355 million soums, but the claim was initially rejected by the court on April 7, 2023. Dissatisfied, the case was escalated to the Oliy Sud, which overturned the previous rulings.

On February 5, the Karshi inter-district economic court revisited the case and ordered the recovery of 355 million soums from the Nishon district branch of the Compulsory Enforcement Bureau in favor of the farmer.
