Driver responsible for the death of a pedestrian after race in Tashkent was released

In May of this year, a traffic accident in the Sergeli district of Tashkent resulted in the death of a 27-year-old pedestrian, who was struck by a Kia driver during an illegal car race.

After serving four months in detention, the driver responsible for the fatal accident has been released. The Tashkent City Courts' press service provided this information to QALAMPIR.UZ.

According to court documents, the defendant, 24-year-old A.Kh., was initially sentenced by the Sergeli District Court on August 14. He was deprived of his driving privileges for two years and sentenced to three years of imprisonment. The court confirmed that the driver had violated multiple traffic regulations, was speeding, and hit a pedestrian.

However, the defendant’s lawyer filed an appeal against the original verdict. During the appeal hearing on September 12, the legal representative of the victim, B.K., stated that the driver's family had fully compensated them for material and moral damages. As a result, the victim's family no longer had any claims against the driver and requested a more lenient sentence.

M. Komilov, the deputy head of the Tashkent City Prosecutor's Office, who attended the court session, argued against accepting the appeal.

The court took into consideration several mitigating factors, including the defendant's lack of a prior criminal record, his admission of guilt, and remorse, family circumstances, and the absence of further claims from the victim's family. As a result, under Article 72 of the Criminal Code, A.Kh.'s sentence was adjusted.

The initial prison sentence of three years was reduced, with the four months and two days already served deducted, leaving two years, seven months, and 28 days to be served under probation. The main punishment was considered conditional, and the driver was released from the courtroom with a two-year probationary period.

During the probation period, A.Kh. is prohibited from leaving Uzbekistan without permission and is required to report any changes in his place of residence, study, or work to the authorities overseeing his behavior. He must also register periodically with these authorities.
