From now on, any damage caused by an unlawful decision, action, or inaction of a state body or its official will be compensated at the expense of that official. This was discussed today, August 19, during the regular session of the Legislative Chamber of the Oliy Majlis in connection with the draft law under consideration.
It was noted that the draft law was reviewed article by article in its second reading. According to the document, a procedure is established for compensating damages, including reimbursement of amounts paid from the territorial compensation fund, which shall subsequently be recovered in full through recourse from the official of the state body found guilty. The procedure for forming the resources of the territorial compensation fund is also defined.
In other words, the draft law introduces a unified procedure for compensating material or moral damages inflicted on individuals or legal entities, as confirmed by a court decision that has entered into legal force. Compensation will be paid from territorial compensation funds under the Council of Ministers of the Republic of Karakalpakstan, regional administrations, and the Tashkent city administration. The reimbursed amount will then be recovered through recourse from the guilty official via the relevant state body.
During the preparation of the draft law for the second reading, the document was further refined based on issues, proposals, and recommendations raised by political party factions and deputies. Inconsistencies in certain provisions were eliminated, and key concepts were revised from a legal and technical standpoint.
As noted during the session, the purpose of this law is to ensure citizens’ constitutional rights to have damages caused by unlawful decisions, actions, or inaction of state bodies or their officials compensated by the state, while also establishing the liability of guilty officials in accordance with the law.
At the session, the draft law was adopted by deputies in the third reading and sent to the Senate.
