“Aka Sharif’s” brother sentenced for insulting his brother on YouTube

The brother of Tolib Hojiev, A.H., known in the Uzbek film world for his role as “Aka Sharif,” has been held accountable. The Yakkasaroy District Criminal Court of Tashkent issued a verdict on March 20, 2025.

According to a court document available to QALAMPIR.UZ, actor Tolib Hojiev’s biological brother, A.H., commented on the YouTube episode of the “Unrevealed Secret” program broadcast on “Milliy TV” on October 8, 2024, titled “My Brother Blackmailed Me,” through his own profile. He publicly revealed his brother’s personal secrets and insulted him with various words.

At the court hearing, the defendant, A.H., partially admitted his guilt and stated that there had been a coldness between him and his brother since April 2022. In the 33rd minute of the show, he insulted his brother by referring to him as “our less capable brother, a poor lawyer, internal jealousy, [he] wanted to imprison me,” and that the posting of this show on the YouTube platform damaged his honor, dignity, work ability, and reputation in society. He claimed that his brother did this because of personal enmity with him and that, in order to prove this, he expressed his thoughts in the comments section under the “Unrevealed Secret” show posted on the YouTube platform.

A.H. now regretted what he had done and requested that such a situation not be repeated, taking into account his family circumstances and asking for a fair hearing of the case.

However, his brother and the victim, Tolib Hojiev, stated at the court hearing that his brother had insulted him with derogatory words such as “Godless,” “Faithless,” “Fatherless,” “Nahs,” “Prostitute,” “White father,” “Dishonorable,” “Father-in-law,” and so on, and requested legal action against his brother.

The court, having heard the conclusion of the state prosecutor, the testimony of the defendant A.H., the victim, and the witness, found that the defendant’s guilt in committing the crime, in addition to his partial confession, was fully confirmed by the evidence mentioned above, including the conclusion of the forensic linguistic examination, the decision to recognize the object as material evidence, the confrontation protocols, and a collection of other objective evidence in the criminal case, which was examined and evaluated in accordance with Article 95 of the Criminal Procedure Code of the Republic of Uzbekistan.

Accordingly, in accordance with Articles 20 and 28 of the Constitution of the Republic of Uzbekistan, Articles 454-457, 463, 465-468, 471-473 of the Criminal Procedure Code of the Republic of Uzbekistan, the court ruled as follows:

“A.H. shall be found guilty of committing the crime provided for in Part 2 of Article 140 (Insult) of the Criminal Code of the Republic of Uzbekistan and shall be sentenced to correctional labor for a period of 1 (one) year, with a deduction of 15 (fifteen) percent of his salary to the account of state revenue.

The term of the sentence shall be calculated from the date of commencement of work at the enterprise, institution, or organization to which the convict was sent to serve the sentence. Control over the execution of the sentence shall be entrusted to the Federal Bureau of Internal Affairs of the Akkurgan District of the Tashkent Region.

After the sentence enters into legal force:

The appropriate measures applied to A.H. The precautionary measure of a reprimand for misconduct should be canceled. It should be explained to interested parties that they have the right to apply to the court in a civil procedure to recover material and moral damage caused by the defendant’s crime.”

It should be recalled that earlier, a citizen who insulted TV presenter Nilufar Sotiboldieva was sentenced to 1 year of correctional labor.
