Individuals under house arrest are monitored by an electronic bracelet

In Uzbekistan, an electronic bracelet is used for individuals under probation control who have been brought to administrative responsibility for violations of public order while serving a sentence in the form of restricted liberty. This is stated in the law "On Probation" signed by the President today, August 7.

According to the law, placing a person on probation is carried out by an employee of the district (city) probation department at the place of residence of the individual by entering data into the probation information system. An electronic monitoring device (electronic bracelet) is used based on the decision of the head of the district (city) probation department against a person under probation supervision who has been officially warned about not fulfilling the requirements of the order of serving a sentence in the form of restricted liberty or has been brought to administrative responsibility for offenses related to public order violations during the period of serving a sentence in the form of restricted liberty.

It is noted that educational influence on persons under probation control is carried out to form behavior that obeys the law and respects societal rules. The behavior of persons under probation control is evaluated every three months based on established criteria and is reflected in their social and psychological characteristics.

The Cabinet of Ministers ensures the implementation of a unified state policy in the field of probation. The Probation Service of the Department of Public Security of the Ministry of Internal Affairs is the competent body in the field of probation.

Entities assisting in the implementation of probation supervision include:

- Labor bodies;
- State health system management bodies and health institutions;
- The Family and Women's Committee and its regional units;
- Republican executive authorities and educational organizations in the field of education;
- The Youth Affairs Agency and its regional units.

The basis for placing a person on probation is a legally binding judgment, decision, or order of the court, as well as an act of amnesty or pardon. An electronic bracelet is worn on the lower leg of a person who is under house arrest or a sentence of restricted liberty. In cases where it is not possible to wear an electronic bracelet on the leg of a person under house arrest or a penalty of restricted liberty (due to bone fractures, other injuries, or medical treatment), it is allowed to wear an electronic bracelet on the wrist.

An electronic bracelet is worn on a female person by an employee of the same gender (the senior inspector for women's issues of the crime prevention unit of the public security service of the internal affairs body). An electronic bracelet cannot be worn by a pregnant woman, a person suffering from a disease specified in the Annex to this Regulation, or a person with a physical disability. A person subject to house arrest or restriction of liberty shall not remove the electronic bracelet from their leg (or arm) during the execution of house arrest or restriction of liberty and shall ensure that it remains in constant working condition.

If the visual signal of the electronic bracelet is triggered, the public security service officer, together with the prevention inspector, depending on the situation, shall eliminate attempts by the person who has been sentenced to house arrest or restriction of liberty to remove the electronic bracelet, damage it, or escape (through stopping or strengthening control). In the case of an escape by a person who has been sentenced to house arrest or restriction of liberty, measures aimed at pursuing and apprehending them shall be taken.

During the process of clarifying the reasons for the activation of the visual signal of the electronic bracelet, if it is confirmed that the person who has been sentenced to house arrest or restriction of liberty has escaped, the public security service officer will immediately attract additional forces and means

from the internal affairs bodies. They will use the GPS signal transmitted from the electronic bracelet worn by the escaped person to locate and detain them. These actions will continue until the fugitive is apprehended.
