4353In Uzbekistan, warrants for searches, wiretapping, and seizure of property are transferred from the prosecutor to the court. President Shavkat Mirziyoyev mentioned this in his address to the chambers of the Oliy Majlis today, 20 December.
"Now, the investigator cannot freeze any property as being related to the crime. After all, are we doing our bit to strengthen the privacy of private property? "From now on, any action to restrict property rights will be made only through the court," said the head of state.
Systematic measures will also be taken to improve the quality of investigations.
According to the President, the investigation should work to find out the truth by exposing the crime and not accusing the person.
"At the same time, a separate corps of prosecutors will be formed to take part in hearing cases in court. They are specially trained, it is determined by law that they should be impartial and independent when considering the case in court," says Shavkat Mirziyoyev.
The rights granted to the defender in the provision of justice are also reviewed and inadequate powers are given.
"Why is the lawyer not given a copy of the decision to initiate and terminate the criminal case? How can we talk about equality in such a situation? "Now, the criminal case is accepted to the courts not only with the indictment, but with the opinion of the defender," The head of state said.
According to him, a system will now be introduced in which the prosecutor and the court will carefully study every case of the accused's refusal to have a lawyer.
