A 32-year-old woman who assaulted her husband with a stone in the Kattakurgan district of the Samarkand region has been sentenced to four years in prison. QALAMPIR.UZ reviewed the court ruling in the case.
According to the verdict, the defendant, X.H., frequently argued with her common-law husband, X.A., due to ongoing family disagreements during their time living together. However, they had been living separately in recent months.
On January 11 of this year, around noon, X.H. arrived at the Charog'on residential complex in Kattakurgan district to collect her belongings. A quarrel broke out once again, during which X.H. struck X.A. in the left eye with a stone, causing serious bodily harm. Medical examination concluded that the injury resulted in a permanent 35% loss of general working capacity.
On July 3, the Kattakurgan District Criminal Court heard the case. The defendant fully admitted her guilt and testified that her spouse frequently consumed alcohol, which led to constant disputes. She also stated that she had not pursued divorce because they have three children and that she still hoped for a positive outcome in their family life.
The victim, X.A., also testified in court, stating that his wife had previously left the house without informing him and accused him of infidelity. He added that he had filed for divorce several times, but she had refused. X.A. noted that he continues to suffer from vision loss in his left eye and requested legal action, as his wife had never apologized for the incident.
Based on the verdict, the defendant, X.H., was convicted under Article 126-1 (Domestic Violence) in conjunction with Article 57 (Lesser Punishment) of the Criminal Code of Uzbekistan. According to paragraph "a" of Part 1 of Article 62 (Calculation of Time Served), the 86 days she spent under house arrest from April 9 to July 3 were counted toward the sentence, with each day equaling one day of imprisonment. As a result, she is required to serve 3 years, 9 months, and 4 days of the sentence in prison.
