Tea enterprise involved in the copying was fined

It was found that the trademark of the "And Zamin Tea" production company is similar to that of "Max-Tea" LLC. This was reported by the Committee for the Development of Competition and Protection of Consumer Rights.

It is noted that on August 9, 2024, the Committee for the Development of Competition and Protection of Consumer Rights, based on the application of "Max-Tea" LLC, considered a trademark dispute between "Max-Tea" and "And Zamin Tea" LLC, both engaged in the production and distribution of tea products.

In particular, it was determined that "And Zamin Tea" LLC introduced two types of products into civil circulation under the trademark "BEKOY-TEA." However, the packaging of these products was found to be similar to that of "BEGOYIM," which had been previously introduced into civil circulation by "Max-Tea" LLC. The similarity extended to the combination of types and forms of trademarks on the packaging of blue and black teas, as well as their placement, which was likely to confuse consumers.

Article 21 of the Law of the Republic of Uzbekistan "On Competition" prohibits unfair competition by business entities or other persons for their own interests.

Furthermore, according to paragraph 6 of the "Methodology for Determining Unfair Competition," approved by Appendix 2 of Resolution No. 694 of the Cabinet of Ministers of the Republic of Uzbekistan dated December 29, 2023, the external appearance, form, name, branding, labeling, packaging, and color matching of goods, works, and services introduced into civil circulation by a competing business entity before this regulation are defined as signs of unfair competition.

Upon concluding its review, the Competition Committee found that "And Zamin Tea" LLC had violated Article 21 of the Law "On Competition" of the Republic of Uzbekistan and imposed a financial penalty. Additionally, an order was issued to rectify the violation and prevent future occurrences.

It should be noted that previously, due to manipulative actions against "Real Agro Cotton" UK, appropriate measures were also applied.
