Reforming charitable donations: Uzbekistan sets clear guidelines

In Uzbekistan, individuals who violate the procedure for collecting sponsorship donations may face fines. This is outlined in the draft law “On Amendments and Addenda to Certain Legislative Acts of the Republic of Uzbekistan to Improve the Procedure for Carrying Out Sponsorship Activities,” which was published for public discussion on February 26.  

The draft law proposes an amendment to the Code of Administrative Responsibility by introducing Article 239, Part 2 (Violation of the Requirements of the Legislation on Sponsorship). It stipulates that violations of the procedure for collecting sponsorship donations will result in fines ranging from 3 to 5 times the base calculation amount (1,125,000 to 1,875,000 sums) for individuals and 5 to 7 times (1,875,000 to 2,625,000 sums) for officials.  

Additionally, the draft law establishes new mechanisms for state support of sponsorship activities, regulates the collection of sponsorship donations, and sets guidelines for installing and using donation boxes. It also outlines requirements for disclosing information about sponsorship donations to ensure transparency.  

The draft law further specifies that violations related to the installation and use of donation boxes, provided there are no signs of an offense under Article 188, Part 3 (Begging), will be subject to fines ranging from 3 to 5 times the minimum wage.  

Moreover, if a charitable organization exceeds the legally established financial limit for its own operational expenses within a financial year—without signs of a criminal offense—it will be subject to a fine of 3 to 5 times the minimum wage for officials.  

The adoption of this draft law is expected to enhance oversight of sponsorship activities, prevent violations in the collection of sponsorship donations, ensure greater transparency in sponsorship organizations, and strengthen public trust.  

The public discussion of the draft law will continue until March 7.
