Qobul Dusov to serve his sentence in a penal colony

41787It was announced that former deputy Qobul Dusov will now serve his sentence in a penal colony. This follows his detention in the Samarkand region on January 24, as reported by the Ministry of Internal Affairs of the Republic of Uzbekistan. Aziz Obidov, the press secretary of the Supreme Court, provided clarification regarding Dusov’s detention.
According to the verdict of the Chilanzar District Criminal Court issued on November 22, 2024, Qabul Dusov (born in 1984 in the Samarkand region) was found guilty of committing a crime under Part 3, Subparagraph "a" of Article 140 (insult) of the Criminal Code. He was sentenced to 1 year of restriction of liberty. Under the terms of the court ruling, Dusov was restricted from leaving his place of residence during certain hours of the day, specifically from 9:00 p.m. to 7:00 a.m. He was also prohibited from using the Internet, participating in public and other events, and was required to report to the Probation Department of the Federal Penitentiary Service once a month. Additionally, Dusov was not allowed to change his place of residence without the consent of the supervising authorities.
However, according to a submission from the Probation Department of the Yashnabad District Internal Affairs Bureau, Dusov has failed to comply with the restrictions and prohibitions imposed on him. "Taking into account the fact that Qabul Dosov has not embarked on a path of moral recovery, that he has been deliberately evading serving his sentence without complying with restrictions and prohibitions, that he has not drawn a positive conclusion from preventive interviews conducted with him several times, and that there is no possibility of educating him without isolating him from society. The court requested, in accordance with Article 481, Paragraph 6 of the Criminal Code and Article 444, Part 3, Paragraph 'a' of the Criminal Executive Code (liability for violation of the procedure and conditions for serving a sentence in the form of restriction of liberty), to replace Qobul Dosov's unserved sentence of 11 months and 2 days of restriction of liberty with deprivation of liberty for the same period," the report states.
The court verdict against Dusov has been registered and sent for execution, and he has been informed about the laws and regulations regarding the serving of his sentence. A warning was issued under Part 6 of Article 481 of the Criminal Code, and receipts regarding this were also obtained.
The report highlights further developments regarding Qobul Dusov’s legal case. Despite the court's explanation of the requirements outlined in Parts 5 and 6 of Article 48-1 of the Criminal Code, including the additional ban on using the Internet, it was found that from January 4 to January 11, 2025, he had posted materials of various content on a Telegram channel under his name. As a result, he was summoned to the Probation Department of the Yashnabad District Internal Affairs Bureau, and a disciplinary penalty in the form of a warning was imposed on him on January 11, 2025, as per Part 1 of Article 44-4 of the Criminal Executive Code.
The Ministry of Internal Affairs’ Cybersecurity Department issued a disciplinary warning to Qobul Dusov on January 24, 2025, and the court, after reviewing the case documents, deemed it necessary to proceed with the application for further actions.
"In accordance with Part 6 of Article 481 of the Criminal Code, if a person intentionally evades serving a sentence in the form of restriction of liberty, as well as fails to fulfill the obligations imposed on him by the court, the court may replace the unserved term of the restriction of liberty with another type of punishment," the report further states.
As a result, the Yashnabad District Court for Criminal Cases, in its ruling on January 24, 2025, upheld the application of the Probation Department, and the unserved term of restriction of liberty imposed on Qobul Dusov for 11 months and 2 days was converted to imprisonment for the same duration. This new sentence is to be served in correctional colonies.
It is important to recall that in November 2024, the Chilanzor District Criminal Court concluded the open trial of Qobul Dusov, finding him guilty under Part 3, Paragraph "a" of Article 140 (insult) of the Criminal Code. The verdict was related to his actions against Farhod Bokiyev, the Deputy Minister of Preschool and School Education, and resulted in a sentence of 1 year of restriction of liberty.
