A former court official sues the court in Bukhara

Up until July 17 of last year, an employee who served as a clerk in one of the district criminal courts in the Bukhara region filed a lawsuit against the same court. This information was reported by the QALAMPIR.UZ source.

It is noted that in this application, a claim of 40 million soums was made to compensate for the period of delay in issuing the work book and for the moral damages incurred.

The plaintiff had worked as a clerk at the district criminal court from February 8, 2018, to July 17, 2023. On February 17, 2023, according to the relevant order of the court chairman, he was dismissed, and the employment contract was terminated.

It was stated that the defendant, namely the district court, did not issue the work record of the former employee until January 5, 2024, which amounted to 5 months and 17 days without any justification.

"As a result, I have been unable to secure employment by signing an official employment contract, and I have not received any salary or work experience," stated the claimant.

According to legislation, "on the day of termination of the employment contract, the employer must provide the employee with their employment record or an extract from the electronic employment record and a copy of the order on termination of the employment contract."

The former court official referenced articles 125, 171, and 320 of the Labor Code of the Republic of Uzbekistan, the Decision of the Plenum of the Supreme Court "On the practice of applying legislation regulating the termination of employment contracts by the courts," and paragraphs 3.1 and 2.20 of the instruction "On the procedure for maintaining employment records." Primarily, they requested the court to award 40 million soums in compensation.

Additionally, in the statement of claim, it was requested to annul the entry in the labor book regarding the dismissal on July 17, 2023, i.e., the grounds (reasons) for the termination of the employment contract.
