Alimony debtors are restricted in marriage and other rights

7047In Uzbekistan, alimony debtors are now prohibited from driving and marrying. This was stated in the decree of Uzbekistan President Shavkat Mirziyoyev «On measures to further accelerate the work on system support of the family and women».
According to the decree, if the alimony payer has obligations under other executive documents, the money recovered from the debtor shall be distributed in the manner and order established by law, after full payment of the arrears of the alimony. Similarly, fines imposed on the debtor in enforcement proceedings and the costs of execution are recovered after full payment of current debts on alimony.
In addition, the practice of posting information about persons who refuse to fulfill alimony obligations and were declared wanted will be introduced on official websites of law enforcement agencies, as well as publications in State media. This will enable citizens with information about wanted persons and their property to contact law enforcement agencies and internal affairs departments.
The Ministry of Justice and the Office of the Procurator-General have been instructed to submit a bill within three months on improving the effectiveness of the alimony recovery system. This includes, among other things, the following:
If there is a maintenance debt pending its full payment:
- the debtor’s right to manage is temporarily limited;
- public services which have access to give a license and permit to the debtor are temporarily unavailable.
It also defines alimony arrears as an obstacle to marriage.
It was noted that the State trust fund «Alimony Payments» will be established under the Enforcement Bureau and 50 billion sums will be allocated from the Development Fund of the Enforcement Bureau.
In cases when it is not possible to recover the amount of alimony from persons who are obliged to pay maintenance within three months, the fund of the State Trust Fund «Alimony Payments» will be directed to the one-time payment of the alimony debts, and the it will be recovered from the debtor with an obligation to pay alimony.
It is stated in the document that the Prosecutor General’s Office (Yuldashev N.T.) and the Ministry of Finance (Ishmetov T.A.) have been instructed to set up a state trust fund “Alimony payments” and to submit the draft Resolution of the government on the procedure for determining the number of alimony arrears and categories of persons to the Cabinet of Ministers within two months at the expense of the fund.
