Compensation paid: Court replaces jail time for former transport official (video)

Earlier, it was reported that the former head of "Toshshahartranshizmat" JSC, Anvar Jorayev, who was sentenced to 7.5 years in prison for crimes such as embezzlement of state property and fraud, had been released. After this development sparked widespread discussion, the Supreme Court issued an official statement regarding the matter.
As is known, according to the verdict of the Yunusabad District Court on Criminal Cases dated February 3, 2025, Anvar Jorayev and 20 employees of "Toshshahartranshizmat" JSC and its affiliated bus depots were found guilty of committing crimes under Article 167, Part 3, Subparagraph "a" and other provisions of the Criminal Code (embezzlement or misappropriation). During the preliminary investigation, 10 out of 21 defendants were remanded in custody as a preventive measure.
The court sentenced six defendants to imprisonment, including Anvar Jorayev, who received a sentence of 7 years and 6 months. Six defendants were released from prison, while two who had remained at large were sentenced to imprisonment and taken into custody directly from the courtroom.
The court's verdict ordered the recovery of 2,475,687,526 soums from Anvar Jorayev and his co-defendants. The damages were to be compensated by seizing two houses belonging to the defendants, with any excess amount to be transferred to the state.
“Based on the appeals filed by Anvar Jorayev and 10 other defendants, as well as the protest submitted by the prosecutor, the case was reviewed by the Tashkent City Court in appellate proceedings. During the hearings, the damage caused by the defendants was fully compensated,” the report states.
It is worth noting that Part 4 of Article 167 of the Criminal Code stipulates that if the material damage is compensated, penalties in the form of restriction or deprivation of liberty shall not be applied.
Therefore, by the ruling of the Court of Appeal dated June 5, 2025, since the damage caused by the main offense had been compensated, the defendants were given sentences not involving deprivation of liberty, and the deposited funds were transferred to the state.
In addition, two houses purchased with criminal proceeds and designated for compensating damages were confiscated in favor of the state. It has also been announced that parties dissatisfied with the ruling may file a complaint or protest with the Tashkent City Court by Article 510 of the Criminal Procedure Code (review of court judgments and rulings in audit procedure).
It should be remembered that in February 2024, Anvar Jorayev, then chairman of the board of "Toshshahartranshizmat" JSC, was arrested. As a result of operational-search activities conducted by the State Security Service in the transport sector, several legal violations were identified within the system of "Toshshahartranshizmat" JSC. Anvar Jorayev, in collusion with heads of branch bus depots, caused significant financial harm to the state by embezzling spare parts and fuel products.
