Jahangir Ulugmurodov's sentence is changed, and a lighter sentence is given

According to the decision of the Supreme Court Criminal Trial Panel of the cassation instance on July 28, 2023, the judgment issued against Jahangir Ulugmurodov, who had been imprisoned for three years, was altered. He was now sentenced to Article 244-1, Part 3, Clause "g" of the Criminal Code, with Article 57 of this Code (restriction of freedom) being applied for a period of 3 years. This information was conveyed by Aziz Obidov, press secretary of the Supreme Court.

On July 28, the criminal trial panel of the Supreme Court at the cassation instance reviewed the appeal filed by lawyer Abdumalik Abdullayev against the sentence passed by the Akkurgan District Court on May 8, 2023, and the decision of the appellate instance of the criminal trial panel of the Tashkent Regional Court on July 17, 2023, pertaining to Jahangir Ulug'murodov (born in Tashkent in 2002).

During the court session, it was noted that the lower courts had correctly established the details of the criminal case against Jahangir Ulugmurodov and arrived at a reasonable conclusion regarding his guilt.

The verdict of the court, finding Ulugmurodov guilty of committing the specified crime, was based on the preliminary investigation, witness testimonies from the first-instance court session, expert testimony from the appellate instance, statements, reports, photo tables, explanatory letters, conclusions of the court's theological and literary studies expertise, and a collection of other reliable and acceptable evidence.

The Court of First Instance properly classified Jahangir Ulugmurodov's criminal actions under Article 244-1 of the Criminal Code (preparation, storage, distribution, or display of materials that threaten public safety and public order), Part 3, Clause "g". Despite considering factors like his youth, student status, lack of prior convictions, positive evaluation from his educational institution, family situation, and sincere remorse for his actions as mitigating circumstances, the court sentenced him to imprisonment, stating that moral correction without separation from society was not possible.

Article 509-9 of the Code of Criminal Procedure grants the court of cassation the authority to change the verdict of the court of first instance and the decision of the appellate court when reviewing a criminal case.

For this reason, the cassation trial panel modified the court decisions issued against Jahangir Ulugmurodov, taking into account his youth, student status, lack of prior convictions, positive evaluation from his educational institution, family circumstances, remorse for his actions, and subsequent behavior.

Consequently, in accordance with the ruling of the cassation instance of the Supreme Court Criminal Trial Panel on July 28, 2023, the court decisions against Jahangir Ulugmurodov were amended, and he was sentenced under Article 244-1, Part 3, Clause "g" of the Criminal Code. Article 57 of the Code was applied (imposing a lighter sentence), resulting in a prison term of 3 years.

Considering the 5 months and 4 days Ulugmurodov spent in prison from February 24, 2023, to July 28, 2023, the sentence of restriction of liberty was reduced to 2 years and 26 days.

Jahangir Ulugmurodov was ordered to serve the sentence of restriction of liberty at his place of residence and was prohibited from leaving the place of residence between 22:00 and 06:00.

The requirements of Article 48-1 (restriction of liberty) of the Criminal Code, parts 5 and 6, were explained to Ulugmuradov, and he was immediately released from prison at the place of execution of the sentence.

The appeal of lawyer Abdumalik Abdullayev for Ulugmuradov's acquittal under his protection was not granted.
