The Constitutional Court reveals a norm against the constitution in the law adopted last year

8395The part of the law of the Republic of Uzbekistan «On amendments to some legislative acts of the Republic of Uzbekistan» adopted on 21 April 2021, concerning articles of the Civil Code has been declared unconstitutional. Such a decision was made yesterday 31 May, at a session of the constitutional court.
The court consisted of the Chairman of the constitutional court of the Republic of Uzbekistan M.Abdusalomov, judges A.Gafurov, F.Kayumov, S.Koshayeva, B.Mirboboev, G.Pirjanov and K.Uljayev, and the senior expert K.Khamidova, it considered the complaint of a citizen M. Hasanova on the unconstitutionality of the norms of Articles 197 and 206 of the Civil Code of the Republic of Uzbekistan and Articles 11 and 27 of the Housing Code and their compliance with the constitution.
Citizen M.Khasanova and her lawyer F.Akramov and the Judicial and Antitrust Committee of the Senate of the Oliy Majlis (Parliament) of the Republic of Uzbekistan, the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan, Supreme Court of the Republic of Uzbekistan, Prosecutor General's Office of the Republic of Uzbekistan, Commissioner of the Oliy Majlis for Human Rights (Ombudsman), Commissioner for the Protection of the Rights and Legitimate Interests of Business Entities under the President of the Republic of Uzbekistan, of Uzbekistan. Representatives of the National Centre of the Republic of Uzbekistan on Human Rights participated in the court meeting.
In accordance with the decision of the constitutional court of the Republic of Uzbekistan of 31 May, the part of the Articles 83, 166, 198, 199, and 206 of the Civil Code in Paragraph 12 of Article 55 of the law of the Republic of Uzbekistan "On Amendments to Certain Legislative Acts of the Republic of Uzbekistan" was adopted on 21 April 2021, and the part of Article 197 of the Civil Code related to property rights which says that "... property rights shall be revoked by the law, abolishing property rights."
