11949Uzbekistan legislation also contains norms that can not be accomplished or are difficult to enforce. This was stated by President Shavkat Mirziyoyev at a meeting with members of the Constitutional Commission today, 20 June.
“Most of us know that ancient Roman law had golden rules. Examples include such rules as “Do not order anyone a task that is impossible to accomplish” or “The law does not require the thing impossible”.
Unfortunately, there are some norms in our national legislation that cannot be accomplished or are difficult to be enforce. In fact, the law should never initiate excessive demands on the people,” - Mirziyoyev said.
He noted that excess demands mean first, overspending. Moreover, it leads to corruption.
“A case in point, a citizen has a three-month loan in the amount of 3 million soms from a mortgage credit.
Under the current law, the bank sues the debtor. However, in this case, the claim is submitted not for 3 million soms, real debt, but, an unpaid portion of the law, for example, for 250 million soms.
The court will consider the application and make a decision on the recovery of the state fee in the amount of more than 10 million soms from the debtor and the termination of the contract. Think about it, how can a citizen who could not pay 3 million soms, pay 10 million state fees?” - the president said.
Shavkat Mirziyoyev proposed to introduce a new norm in the constitution to prevent such absurd cases.
"In the investigation of the cases related to administrative, civil, economic, criminal and other issues, the legal measures applied to a person must be sufficient to achieve a legitimate goal and create the greatest possible relief for the person," - he said.
