Homes will no longer be demolished without residents’ consent

The renovation, reconstruction and improvement of outdated and emergency-condition residential and non-residential buildings will now be carried out according to a clear procedure, and the consent of property owners will be obtained when renovation is implemented. President Shavkat Mirziyoyev has signed Law No. 1149 “On Urban Renovation.”

According to the law, the grounds for carrying out urban renovation include the presence of residential and non-residential buildings in the renovation area that are outdated, unsuitable for living or use, in emergency condition, or circumstances that seriously affect the social life of the local population.

Urban renovation consists of the following types:

  • reconstruction of an existing facility without changing its main structure;
  • demolition of an existing facility and construction of a new facility of the same category on the vacated land plot;
  • creation of green areas and other territorial zones.

A proposal to carry out urban renovation may be submitted on the initiative of the following entities:

  • the state;
  • right holders;
  • third parties.

It was noted that urban renovation support funds will be established under the Cabinet of Ministers, the Council of Ministers of the Republic of Karakalpakstan, regional administrations and the Tashkent city administration. These funds will finance renovation projects and support their implementation.

Consent of property owners will be obtained during renovation

According to the law, open discussions with right holders, meaning individuals or legal entities who own real estate located in an urban renovation area, must be held within two months from the date the renovation project concept is developed.

The document emphasizes that one of the mandatory conditions for carrying out renovation is obtaining notarized written consent from at least four-fifths of the owners of each facility to include the facilities in the renovation project.

In this case, a right holder may, at their own choice, receive compensation or participate as a contributor in the implementation of the renovation project.

Compensation may be provided in the following order:

  • transfer of ownership of a newly built residential or non-residential facility in the area where urban renovation is being carried out;
  • transfer of ownership of a residential or non-residential facility in another location;
  • cash payment;
  • other forms provided for in the settlement agreement.

For reference, renovation is the process of renewing and reconstructing areas that are outdated, in emergency condition or do not meet modern requirements.
