An 18-year-old female student in Tashkent is accused of terrorism and sentenced to 5 years

According to the judgment of the Yunusabad district court on criminal cases, on 18 August of the current year, D. Jumayeva (born in Tashkent in 2004) was charged with criminal offenses under Article 155-2 of the Criminal Code (passing training for the purpose of carrying out terrorist activities, exit or movement toward hostilities) part 1, article 244-1 (preparation, storage, distribution or display of materials that threaten public safety and public order) part 3 paragraph "g" and article 244-2 (religious extremist, separatist, fundamentalist or other prohibited organizations creation, leadership, participation in them) was found guilty of part 1 and sentenced to imprisonment for a term of 5 years and 3 months.
According to the decision of the appellate instance of the criminal trial panel of the Tashkent city court on 18 October of the current year, the sentence of the Yunusabad district court on criminal cases dated 18 August was changed, and D. Jumayeva was charged with Article 244-1 of the Criminal Code, 3- paragraph "g" of the part is removed, and the punishment imposed by this article and according to the procedure of article 59 is cancelled. D. Jumayeva was sentenced to 5 years imprisonment imposed by Article 244-2, Part 1 of the Criminal Code, and 4 years 8 months of imprisonment by Article 155-2, Part 1 of this Code. D. Jumayeva was sentenced to imprisonment for a term of 5 years and 2 months, in addition to the punishments imposed on the basis of Article 59 of the Criminal Code. In accordance with Article 62 of the Criminal Code, each day of D. Jumayeva's imprisonment from 9 April to 13 June of this year is equal to one day of imprisonment, deducting 2 months and 4 days of imprisonment from the sentence. The sentence of imprisonment was suspended for 4 years 11 months 26 days.
"Of course, it is extremely regrettable that D. Jumayeva, who has just turned 18 years old, was sentenced to imprisonment. The fact that D. Jumayeva "entered the university and the prosecutor asked for leniency" is widely discussed on social networks. However, it should not be forgotten that whether it is a student or an elderly person, the law is equal to everyone, and punishment for crime is inevitable. On the other hand, many of our compatriots who have an active civil position also protested that the culprit was sentenced to imprisonment. Of course, such carelessness, not being indifferent to the fate of D. Jumayeva, a child of this country, is commendable.
However, D. Jumayeva secretly bought a suitcase from her relatives in order to go abroad to participate in terrorist activities. On 15 March of the current year, she managed to have a passport issued to travel abroad. She kept them secretly in the house of her acquaintance. The saddest thing is that on 26 March 2022, at 11:00 a.m., she planned to go to Syria via the "Uzbekistan-Turkey-Syria" route and was revealed and detained in the procedural order while trying to participate in the activities of a terrorist organization. The court imposed a prison sentence, taking into account that there is no possibility of re-education by leaving D. Jumayeva in the open," the official report said.
It is noted that the testimony of D. Jumayeva, in which she fully confessed her guilt during the investigation of the crime and the trial of the first stage court, the testimony of witnesses, the seizure of mobile phone devices for examination and inspection statements, written correspondence on 12 sheets of A4 paper, conclusions of the forensic technical expertise and attached DVD+R discs, conclusions of the forensic theological expertise of the experts of the Committee on Religious Affairs under the Cabinet of Ministers and the crime was fully substantiated by a set of other objective evidence available in the documents of her case.
"This is far from saying that the court decisions regarding D. Jumayeva will not change. Already, information is available that the parties dissatisfied with the decision issued by the Tashkent city court have the right to file a cassation appeal or protest to the High Court in the procedures and terms specified in the criminal procedural law," the official message concluded.
