Deadline for preparing cadastral passports extended in Uzbekistan

In Uzbekistan, the timeframe for preparing cadastral passports has been extended, depending on the type and complexity of the real estate object. This change is outlined in the Cabinet of Ministers' resolution titled “On additional measures to implement the Law of the Republic of Uzbekistan ‘On recognition of rights to arbitrarily occupied land plots and buildings and structures constructed on them’,” adopted on May 27.

According to the resolution, the revised deadlines for preparing cadastral passports are as follows:

- For apartments in multi-apartment buildings: up to 5 working days (previously 3 days)
- For individual housing: up to 8 working days (previously 5 days)

For the non-residential parts of properties and entire multi-apartment buildings:

- Up to 100 square meters: 8 working days
- 100 to 1,000 square meters: up to 10 working days
- 1,000 to 5,000 square meters: up to 15 working days
- 5,000 to 15,000 square meters: up to 20 working days
- 15,000 to 50,000 square meters: up to 26 working days
- Over 50,000 square meters: up to 35 working days

Additional deadlines include:

- For allocated land plots: up to 5 working days
- In case of loss or invalidation of a cadastral passport: a new one is issued within 3 working days

For land plots with perennial trees:

- Up to 1 hectare: up to 15 working days
- From 1 to 5 hectares: up to 20 working days
- From 5 to 10 hectares: up to 26 working days
- From 10 to 100 hectares: up to 35 working days
- Over 100 hectares: up to 40 working days

The resolution also specifies that if the area of the occupied land is up to 2 percent larger than the area indicated in the ownership documents and this excess does not exceed 30 square meters, it will not be considered arbitrarily occupied. Therefore, such cases will not be referred to the tax authorities.

Furthermore, the Cadastre Agency will upload digital documentation related to the land plot, building, or structure into its automated system only if the land is already occupied by a structure. In these cases, the land boundaries will be defined starting from the entrance of the property.

It is worth noting that under a recent Presidential Decree on improving the housing construction sector, Uzbekistan plans to strengthen regulations surrounding shared residential and non-residential construction and to implement a “single housing life cycle” approach to project development.
